Clery Act

According to federal law, West Virginia University must publish and distribute an Annual Security and Fire Safety Report (ASR) to current students and employees and to give notice of its availability to prospective ones. The ASR includes statistics for the previous three years concerning reported crimes that occurred on campus, in certain off-campus buildings or property owned or controlled by West Virginia University, and on public property within or immediately adjacent to and accessible from the campus. The ASR also includes institutional policies concerning campus security, such as policies concerning alcohol and drug use, crime prevention, the reporting of crimes, sexual assault, and other matters. You can obtain a hard copy of the ASR by contacting the W. Va. Univ. Police at 304-293-3136 or by accessing it electronically.

Labor Condition Applications

West Virginia University sponsors foreign national employees in H-1B and E-3 status, which are statuses reserved for those working in a specialty occupation. For these statuses, West Virginia University is required to obtain a certified Labor Condition Application (LCA) (Form ETA-9035) from the U.S. Department of Labor before it may submit a nonimmigrant petition to U.S. Citizenship and Immigration Services (USCIS). 

When it files an LCA, West Virginia University attests that it will adhere to certain regulatory requirements associated with the H-1B and E-3 programs. Amongst these requirements is a notice provision, which stipulates that notice must be provided to U.S. workers on the date an LCA is filed (or within the 30-day period before the LCA is filed). The notice must include:

  •  The number of nonimmigrants the employer is seeking to employ 
  •   The occupational classifications in which the nonimmigrant(s) will be employed 
  •   The wages offered 
  •   The period of employment 
  •   The location(s) at which the nonimmigrant(s) will be employed 

To provide the required notice, West Virginia University has partnered with LaborLess to provide access to the LCAs it has filed for job opportunities which have been filled by H-1B and E-3 candidates. All LCAs filed by West Virginia University are available for public inspection at West Virginia University, International Students and Scholars Services, Purinton House, 1505 University Avenue, Morgantown, WV 26506. 

Complaints alleging misrepresentation of materials facts and/or failure to comply with the terms of an LCA may be filed using the WH-4 Form with any office of the Wage and Hour Division, Employment Standards Administration, U.S. Department of Labor.
